Welcome to trickandfly.ca. These Terms and Conditions ("Terms") govern your use of our website and the services provided by Trick and Fly ("the School", "we", "us", or "our"), located at 150 Katimavik Rd suite 111, Kanata, ON K2L 2N2, Canada.
1. ACCEPTANCE OF TERMSBy accessing this website and/or registering for classes, you agree to be bound by these Terms, all applicable laws in Ontario, and federal laws of Canada. If you do not agree, please discontinue use of the Site immediately.
2. SERVICES AND REGISTRATIONEligibility: Classes are designed for minors. Registration must be completed by a parent or legal guardian aged 18 or older.Third-Party Integration: We use Jackrabbit Class for registration, scheduling, and payments. By using the registration widget, you also agree to Jackrabbit’s technical terms of service.Accuracy: You agree to provide accurate and complete information during registration, especially regarding the student’s age and health conditions.
3. FEES AND PAYMENTSCurrency: All fees are in Canadian Dollars (CAD) unless stated otherwise.Payment Processing: Payments are processed via our third-party provider. Trick and Fly does not store full credit card details on its own servers.Refund Policy: [INSERT SPECIFIC POLICY, e.g., "All sales are final" OR "Refunds are available up to 7 days before the first class minus a $25 admin fee"]. If no policy is stated here, Ontario consumer laws may default in favor of the customer.
4. PHYSICAL RISK AND WAIVERSInherent Risk: Gymnastics and acrobatics involve physical activity and inherent risks of injury.Waiver of Liability: During the registration process via Jackrabbit, you are required to sign a formal Participation Waiver. That waiver is hereby incorporated into these Terms by reference. You acknowledge that participation in classes at our Kanata facility is at your own risk.Health Warranty: You certify that the student is physically fit to participate in the chosen activities and that you have disclosed any relevant medical conditions.
5. CODE OF CONDUCT (ON-SITE)To ensure safety at our Kanata facility:Parents/guardians are responsible for students until the class begins and immediately upon its conclusion.We reserve the right to remove any student or parent whose behavior is disruptive, unsafe, or violates school rules without a refund.
6. INTELLECTUAL PROPERTYThe content on this Site, including logos, text, and photos of our facility/instructors, is the property of Trick and Fly and is protected by copyright laws. You may not use our branding without written permission.
7. LIMITATION OF LIABILITYTo the maximum extent permitted by the laws of Ontario, Trick and Fly shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or participation in classes, beyond the amount paid for the specific service in question.
8. TERMINATIONWe reserve the right to terminate access to our services or the Site at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the School.
9. GOVERNING LAWThese Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ottawa, Ontario.
